DaisyCloud provides a deployment pipeline management platform designed to help users manage projects, monitor system health, and streamline development workflows. We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice.

To access certain features of the Service, you may be required to create an account. You represent and warrant that:

1. Any information you provide is accurate, current, and complete.

4. You accept responsibility for all activities that occur under your account.

Your Content: You retain full ownership of any data, code, configurations, or content you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, and display such content solely as necessary to provide the Service to you.

#6. Privacy and Data Protection (GDPR)

Your privacy is critically important to us. Our collection and use of personal information are governed by our Privacy Policy.

In accordance with the General Data Protection Regulation (GDPR):

• Data Controller: DaisyCloud acts as the Data Controller for your account registration data and billing information.
• Data Processor: DaisyCloud acts as the Data Processor for any personal data contained within the projects and deployments you manage using our Service.

#7. Payment Terms

Certain aspects of the Service may be provided for a fee ("Paid Services"). If you elect to use Paid Services:

1. Billing: You will be billed in advance on a recurring and periodic basis (e.g., monthly or annually).
2. Cancellation: You may cancel your subscription at any time. Your subscription will remain active until the end of the current billing cycle, after which it will not renew.
3. Refunds: Except when required by law, paid subscription fees are non-refundable.
4. Changes: We may modify the subscription fees for the Paid Services at any time. Any subscription fee change will become effective at the end of the then-current billing cycle.

To the fullest extent permitted by applicable law, DaisyCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service;
2. Any conduct or content of any third party on the Service;
3. Any content obtained from the Service; and
4. Unauthorized access, use, or alteration of your transmissions or content.

#10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

#11. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
